Sometimes you can have an idea for business, but there are no resources to implement these ideas. Then entrepreneurs have recourse to investors. Or vice versa: there are free resources that can be invested in order to obtain benefits, but many questions arise how to do this without risking being left with nothing.

Investment is a widespread phenomenon, but at the same time, it is not elaborated well, and the parties to the transaction often find themselves in rather risky situations or even bear losses. To avoid undesirable consequences, we recommend you to pay attention to key points of investing.

The legislation of the Republic of Belarus provides an open list of investment methods, for example:

1.       By real estate purchase (including building construction);

2.       By acquisition of rights to intellectual property;

3.       By acquisition of stocks or shares in a commercial entity;

4.       By other methods.

Attention to investors! It is forbidden to conclude investment agreements with:

1.       Legal entities that occupy a dominant position in the goods market of the Republic of Belarus without the permission of the Antimonopoly authority.

2.       Legal entities or individual entrepreneurs engaged in activities prohibited by legislation. If such facts are revealed, information about the prohibited activities must be reported to law enforcement agencies.

After the object of investing has been selected, it is necessary to conclude an investment agreement in writing.Drawing up an investment contract is a rather laborious process. The benefit and safety of the parties depend on the wording of provisions. For example, difficulties in obtaining profit from investors may arise for the following reasons:

·         The terms of construction or registration of the acquisition of rights are not agreed;

·         No provisions have been formulated for additional costs or work, which may entail additional costs for the investor;

·         The investment object (land, industrial property rights object, etc.) is not specified or incorrectly defined.

It is better to entrust specialists with drafting an investment contract or negotiating about the agreement of its conditions.
