Registration of an intellectual property in Belarus is a necessary procedure for obtaining exclusive rights, for designations that distinguish producers of goods and services, and for the results of creative activity in various industries in the form of patents for inventions, utility models, industrial designs, etc.
In Belarus, the registration of intellectual property is carried out in the National Center of Intellectual Property of the Republic of Belarus abbreviated as NCIP. A business entity or an individual (any natural person) can apply to the NCIP independently or through a representative, which, according to the law of the Republic of Belarus, can be a patent attorney of the Republic of Belarus. Foreign applicants can apply to the NCIP only through a patent attorney of the Republic of Belarus.
The first group includes objects of intellectual property, the rights to which arise regardless of their registration. These are works of literature and art, scientific creations, as well as broadcasting, etc. These are the Copyright Works.
This group also includes computer programs or, in other words, software products. However, as practice shows, without registration, or rather depositing, in case of disputes it can be extremely difficult to prove that you are the author of this computer program or part of it.
The second group includes objects of industrial property rights and equivalent means of identification. It includes:
· Inventions;
· Utility models
· Industrial designs;
· Selection inventions;
· Integrated circuit topography.
Means of identification include:
· Trademarks
· Geographical indication
Separately, it is necessary to indicate such object as a trade secret, or a secret of production, or a know-how. Nowadays, trade secrets are not protected by intellectual property laws, but are regulated by trade secret law.
In practice, in the Republic of Belarus, registration of intellectual property rights is carried out mainly on:
· Trademarks;
· Industrial designs;
· Utility models
· Inventions
The remaining objects of intellectual property belong to the so-called “other objects of intellectual property” and in practice are rarely registered and mainly only foreign applicants make such registrations.
It should be noted that the “domain name” that is often encountered in life does not belong to intellectual property objects, and, therefore, exclusive rights do not apply to it.
