Licensing

Some business activities require special State vigilance and quality control surveillance due to the fact that they can harm nature or the population, affect state interests and safety or the country's market.

To issue permissions the State implements particular activities related to the consideration of its validity period, procedures for verifying compliance with licensing conditions and requirements. These activities are considered the licensing.

According to the Belarusian law, a license is a document that confirms the existence of a permit from the State to engage in certain activities by an economic entity and to comply with established requirements and conditions.

Information on licensing conditions in the Republic of Belarus is contained in the Civil Code, Presidential Decrees No. 450 and No. 71 "On licensing certain types of activities" and "On the procedure of licensing types of activities related to specific goods (works, services)" and other legislative acts.

How to obtain a license?

The issuance of a special permit is carried out on a declarative principle. If an entrepreneur needs a license for work, then with a package of certain documents you need to contact the relevant state bodies. Be informed that it is necessary to obtain a license before starting special activities.

Often our clients are wondering: How to obtain a license? Where should we go?

The answer is simple: the authority body you contact depends on the type of the licensed activity. For example, for the gambling industry, you need the Ministry of Taxes and Levies, for psychological counseling activity, you need the Ministry of Health, while Information assurance systems licensing take place at the Operational and Analytical Center under the President of the Republic of Belarus and so on.

It appears from the above, the licensing is a procedure that has its own subtleties: ranging from the correct preparation of documents, the formation of a file and appealing to the competent authority.

Legal advice in this case will be very helpful. A professional lawyer will be able to tell you what types of your activities require permits, how and when to get it, what should you do if the activity was carried out without an appropriate document, what to do if the permit expires.
